If there are errors in your credit report, it can restrict your housing options and cause landlords to refuse permission. The Fair Credit Reporting Act (FCRA), like an employer background check, allows Consumer Reporting Agencies to ensure that the material in the records is as accurate as possible. This businesses must be honest and unbiased, as well as protect the consumer's right to privacy.


Landlords will test applications in a number of ways, as long as they are non-discriminatory. Both prospective tenants must be asked the same questions. Applicants who are refused tenancy because of a screening study must be told of the grounds for their denial. A landlord can collect background information on their applicants using a variety of approaches and resources. Others use programs that check up information about them, and others do very little scanning.


Landlords must have a "permissible reason" for receiving some kind of customer survey, and tenant screening meets the requirement. Landlords, on the other hand, could only use the details in the records for housing purposes. They must notify a tenant or claimant whether they want to take any adverse action as a result of the details in the study. This may mean turning down a mortgage, having a co-signor, or charging a higher rent than other applicants. This notification may be delivered verbally, in writing, or online.


When a tenant's rights have been abused because they feel there are errors in their background check that are causing complications, state law covers them under the Fair Credit Reporting Act (FCRA).
